1. General conditions of use for buyers

FNAC DIRECT operates a marketplace at https://fnacr.com/ (hereinafter referred to as the "Website") that allows adult buyers (hereinafter referred to as "Buyers" or "you") to get in touch through their intermediaries after registration with sellers, professionals (hereinafter referred to as "Sellers") who are also registered on the Website for the purpose of purchasing new and second-hand products (hereinafter referred to as "Products") offered at fixed prices (hereinafter referred to as "Services").

To use the Services, Buyer must agree, without limitation or qualification, to be bound by these Buyer General Terms and Conditions of Use (the “Buyer Terms and Conditions”). This acceptance is achieved by clicking Confirm when registering for the service.

Sales between Buyer and Seller through the Service are subject to the Service's General Terms and Conditions of Sale ("GTC"), which the Buyer must also accept with each purchase; they are in addition to the Buyer's GTC.

1. Purpose

The purpose of these Buyer Terms and Conditions is to define the conditions under which FNAC DIRECT provides the Buyer with technical tools for the purchase of Products from the Seller as part of the Services.

2. Service description

The Services include a set of tools that enable sellers to connect with buyers in order to offer them products for sale, quote and describe those products, accept orders from buyers, collect prices for purchased products and manage after-sales services for the products sold.

Transactions for the sale of Products through the Service are made directly between Buyers and Sellers. FNAC DIRECT is in no way a seller of the products offered by Sellers through the Service.

3. Access to services

Buyer’s access to the Services is limited to personal use only. When using the Services, Buyer represents that it is acting in a private capacity.

In addition to acceptance of these Buyer Terms and Conditions, access to the Services requires opening an account on the Website. To do this, you must provide data that allows you to be identified. When opening this account, you agree to provide only accurate information and then immediately notify FNAC DIRECT of any changes that affect them using the messaging tools provided to you as part of the Service.

To use the Services, you must use the username and password you created when you opened your account. You agree to keep it confidential and not disclose it to any third party. Indeed, you will be solely responsible for the use of your username and password to access the Services, unless there is evidence of fraudulent use not attributable to you.

You agree to notify FNAC DIRECT Customer Service immediately if your username and/or password is lost, stolen or used fraudulently.

4. Service prices

Opening an account and using the service is free (excluding any connection fees, the price of which depends on your electronic communications operator) and no purchase is required on the website. Fees are only payable when purchasing products from the seller, subject to the conditions set out in the General Terms and Conditions.

5. Personal data

Your personal data is processed by FNAC DARTY PARTICIPATIONS ET SERVICES and FNAC DIRECT as joint data controllers.

Purpose:

Information related to your account and orders is processed for the purposes of creating and managing your account, managing your orders and their tracking, and for fraud prevention, statistical analysis and customer knowledge purposes. FNAC DARTY also uses your data for marketing and targeted advertising purposes (sending electronic communications, postal or telemarketing and performing advertising analysis by combining the data) on its own behalf or as its advertising agency with partners. Depending on your choices, your contact data and profile information may be transferred to agents or commercial partners for commercial marketing and advertising targeting.

Unless you object, FNAC DARTY or a partner may use your phone number to conduct marketing calls. You can read and object to the use of your data for commercial promotion and advertising analysis at any time on your personal data page
